The discrepancy is exactly why I'm not entitled to return it, and i did all the weirdo steps you demanded like have a textile expert look at it and confirm that it was not at all the material or color i ordered, and yes, my card did side with me given all this.

Tip for consumers:
don't

I ordered a dark red-maroon satin dress as pictured on their site, and they sent me a bright purple dress in a rough/matte finish (not satin). They refuse to refund me although the item is totally different than I ordered because it was marked as 'final sale,' and they refuse to acknowledge the law that even if an item is marked 'final sale,' it still has to be the actual same item advertised and ordered, which is it is not! I never got the item I ordered yet they refuse to refund me.

They also broke the timely delivery law yet refuse to refund me on these grounds either. The shipment was delayed past arriving 30 days from the order being placed and then they said it would be shipped by 2/25, but it actually wasn't shipped until 3/1 and they did not provide me a second update on the late shipping that I could approve or deny, but they also refuse to refund me on these grounds.

I've been going back and forth with them for weeks now on what should be a simple matter since it's the basic law in the US.

Tip for consumers:
dispute it with your card and file claims with NJ AG, your state's AG, FTC, FBI online sales crimes, because they won't follow the basic law and refund you.

Dear Jen S. - We have been in contact with you multiple times and provided everything you need to return the item and be refunded in full. Since there is a discrepancy, we do need the item back for inspection prior to us refunding your order. Thank you, PG

I was sent a late shipping notice, which according to US FTC law means that I can reject the late shipping and get a full refund if I contact the company and tell them I'm rejecting the late shipment. If they choose to still send it, then I am still entitled to a refund without having to return the item, as the item is considered a free gift at that time.

So in this case, the same day that I received the late shipping notice (much sooner than the allowable time frame I have as the purchaser), I contacted ASOS customer service and told them that I dd not consent to the late shipment, and so they needed to refund me. They said it was too late for them to cancel the order, which was odd since the email I received was literally about how they couldn't ship it yet, so I don't see why they couldn't/wouldn't just cancel it, but that's their prerogative (following the law and refunding me regardless is not, of course). I explained to them that either way they had to refund me and even if I eventually got the items, I wouldn't have to return them for the refund based on ftc law, so I encouraged them to just cancel it. The customer service person acknowledged the US FTC law and clearly stated that I would get a full refund, and that I would not have to return the items for the refund (see the other documents I uploaded for the transcript: "me: since it's coming later than originally promised, which is why i got the notice, i have the right to refuse the new shipping date and get a full refund
ASOS [05:09:27] Yes that is correct.
Me [05:09:42] this is the ftc law
ASOS [05:09:45] Yes. You will still be refunded for this don't worry... me [05:11:28]. Since i haven't accepted the later shipment time, i don't need to return it for a refund. [05:11:45] so it would probably be best for you to just cancel it now before it's
Sent out. [05:12:24] since i don't have to return it but i am entitled to a full refund, since
Asos sent me a revised ship time, and i'm letting you know now i don't consent to it.
ASOS [05:12:35] Yes you will not return it."). He said he couldn't process the refund yet, but (for some reason) once I gave them the shipping info (which obviously I hadn't received yet since they were shipping it out late -hence this whole thing), they would process the refund without return. When I did find the shipping info, I contacted customer service again, but they broke their agreement and FTC law and refused to refund the order without a return. As you can see, the first customer service rep clearly promised a refund without return (as per FTC law), but then when I took the extra steps (which I probably didn't even need to do) that asos (bizarrely) claimed they 'needed' to process my legally entitled refund, they broke their promise/agreement with me and the law and refused to process my refund.

Tip for consumers:
don't do it

I ordered something they claimed was an overbed desk, which i need due to my disability, but the item they sent is not an overbed desk at all and is only a standing desk which is the opposite of what i need. Since they charged me for a product i did not receive and sent me an unrelated product that i didn't order (the exact opposite of what i ordered, actually), i'm legally entitled to a refund without return. In this case i told them i'd be happy to have it picked up anyway since it's wasting space, but i was informed by the target representatives that they would not provide me reasonable accommodation for my disability and pick up this item, and they said the contracted company that sold the product through their site, spreetail, would also not do so. Even though i told them i could not return it without assistance such as pickup from a carrier (which is pretty common now rather than making people return things in store due to covid), and they refused to provide such reasonable accommodation, they also still refused to refund it without return even though I'm legally entitled to a refund without return since the item i ordered is not the one i received. They said it was up to the spreetail to process such a refund, but they refused to call the company on my behalf to arrange anything. Then when i contacted spreetail they claimed that they needed to talk to a target representative but also claimed they "could not" call target themselves because they "had no outbound phone line" (concerning for other reasons too, like these workers' safety, please investigate or forward to proper company) and i would have to have target call them. I repeatedly told them that i already asked target to call them but they refused. So basically these 2 companies are in a scam together to defraud disabled people in particular and also not provide reasonable accommodation to them as per ADA requirements nor to follow FTC laws.

Tip for consumers:
don't use it.

Products used:
none. i needed an overbed desk. they gave me a standing desk which is the literal opposite of what i need and quite cruel if you think about it, especially when they also illegally deny ada accommodations for pickup or ftc law for refunds

Tip for consumers:
DON'T and check target to see if it's really sent by them/spreetail. in fact, just avoid target all together since they are in cahoots and target does the same illegal things

Products used:
none, useless as i needed a bed desk and they sent a STANDING desk.

Hello Jen,

I am regretfully sorry to hear about the negative experience you had with our company and the Marketplace used to place the order. I was unable to locate the order you are referring to based on the information provided. I would like to look into your order to find the best solution to the problem you have with returning the wrong item you received. If you could provide me with your tracking number or last name and zip code I'd be glad to take a look.

I want to assure you we have a 90-day return window for our Target Marketplace orders, the policy with this marketplace is in fact true where you would contact Target and they will initiate any return, exchanges, or reships from their end ad we only speak with Target representatives to do so. Either way, I am unsure of why you were not able to get a return initiated through Target and I am sorry you have gone through the amount of trouble you did to get this resolved.

Our returns within the return window are 100% free with the provided pre-paid label through FedEx and once the label is received you are able to contact FedEx to have a free pickup scheduled.

I can't express enough how sorry I am that you could not get your return resolved please reply with our order information so that I can investigate it thoroughly for you.

I needed to cancel my hotel reservation because firstly I reserved a room with a bathtub which i need for a disability i have and they changed it to a room without a bathtub and then after that my flight was cancelled by the airline so i couldn't stay at the hotel anyway. Expedia kept giving me the runaround about the refund. They say it's up to the hotel to approve but i contacted the hotel weeks ago and their third party department said they approved the refund and contacted expedia to process it but that expedia would not reply to them and yet when i contacted expedia they kept claiming they never got any messages from the hotel despite all evidence to the contrary, multiple emails from the hotel department with contact info and everything. One day at 1 am i got another email from expedia again falsely claiming they didn't get the information from the hotel in order to refund it but that they would contact me in 8 hours at the latest with an update, but when i reminded them i had told them many times that the hotel did approve the refund and provided the emails proving it, they simply never replied, even 8 DAYS after they said they would. I had to dispute the charge with my card since expedia completely stopped acting in good faith and stopped all communication past their own deadline they set and wouldn't refund my reservation despite their own requirements they set being met. Then the real kicker, after my dispute was of course decided in my favor, I finally got a response about my refund from expedia which just said "Thank you for contacting Expedia with regards on your refund request with Bellagio. Due to your dispute on your bank we highly request you to contact your bank directly for your refund request." wow! I never heard such a thing! They just want customers to file disputes rather than they refunding it themselves! I'm guessing the company puts punitive action against the customer service agents when they process refunds, even if those refunds are legally required or meet expedia's own conditions for refund! This should not be. They need to get their house in order! Until then, do not book with them! Even if the prices are cheaper, it's not worth it, especially if you need to get your refund in a timely manner, because they will literally make you dispute it with your card rather than process it themselves!

Tip for consumers:
i guess just dispute it with your card since that's what expedia will tell you to do anyway. however before you can win the dispute you have to go through all the communication steps with expedia including proof they've ghosted you, lol. find the hotel company's 3rd party dispute department as they will be most likely to authorize a refund.

I was a victim of false advertising/fraud. First, their banner says "Free same-day delivery on orders $35+ when you order by 2PM". There is no footnote or anything noting any exlcusions at all. Second, when I went to checkout, on the checkout page it specifically said "You're saving $12.24 on this order PLUS free shipping!" but then when I placed the order, I was charged $11+ for shipping, even though my total order was $46+ dollars and even though it specifically said the $12.24 was on top of free shipping. When I contacted customer support to get a refund on shipping as free shipping was advertised & gauranteed at checkout, they said there was no way they could do it. They gave all kinds of excuses that blatantly went against what they advertised and what was promised at checkout including that I wasn't getting free shipping anymore because of the $12.24 discount, even though the checkout page specifically said I was getting free shipping in addition to that. They would not honor their agreements and engaged in fruad. Also their customer service chat feature is almost impossible to use because it was a white background with white font, so customers cannot see what/when they are typing.

Tip for consumers:
they engage in flagrant false advertising and they do not honor free shipping or other agreements even on the checkout page, and they will not refund fraudulently charged shipping fees, so just don't shop with them.

Home depot is currently violating FTC laws in refusing to provide a prompt refund when delivery is delayed and later than the advertised and agreed upon time. I ordered a product that was supposed to arrive on 3/31, but it hasn't even shipped yet. It even says on the order page that it was supposed to be delivered 4/1 (already different from what was advertised, but still), and today's date is 4/2. I wasn't given any notice about a delay in shipping, and I do not consent to a delay. Therefore, HD must give me a refund, but I've talked to around 5 associates now and they all claim that they "cannot" follow the law and give me my legally entitled refund. One even said they couldn't cancel my order since it hasn't shipped yet, which makes no sense!

FTC Mail, Internet, or Telephone Order Merchandise Rule: The Rule, issued in 1975, requires sellers who solicit buyers to order merchandise through the mail, via the Internet, or by phone to have a reasonable basis to expect that the sellers can ship within the advertised time frame. The Rule also requires that, when a seller cannot ship within the promised time, the seller must obtain the buyer's consent to a delay in shipping or refund payment for the unshipped merchandise.

I've filed a claim with the FTC and I encourage anyone else in this situation to do the same, since it seems like their basic practice is to break this law.

Tip for consumers:
file a claim with the ftc.

You can't print out separate tickets, they just give you one for everyone, that's ridiculous. I've never seen something like that before. When I complained about that, I got a message creating an account for me, rather than doing anything to address my concerns.
