The law requires that commercial messages:
Tell recipients how to opt out
Honor opt-out requests promptly
Include a valid postal address
Include a clear explanation of how to opt out
Process opt-out requests for at least 30 days
Honor a recipient's opt-out request within 10 business days
The CAN-SPAM Act also establishes rules for subject lines, disclosures, and headers. The law sets penalties for those who break the rules, with each violation costing up to $16,000.
The Federal Trade Commission (FTC) is responsible for enforcing the CAN-SPAM Act.
