I purchased a subscription to TestTube at the promotional rate of $140 on 11/25/2022. I received notification from my credit card company today that my card was charged for $200.60. I contacted the company to let them know that they did not send notification that my subscription would be auto renewed, as is required in California Business & Professions Code Section ******* (b)(2) which states: "The consumer accepted an automatic renewal offer or continuous service offer with an initial term of one year or longer, that automatically renews unless the consumer cancels the automatic renewal or continuous service. In this case, the notice shall be provided at least 15 days and not more than 45 days before the automatic renewal offer or continuous service offer renews." I called the company to explain this to them and spoke to Joan. I let Joan know that the company was required to send notice prior to the auto renewal under California Law. She acknowledged that the company did not send this notice and said that they were not required to because I "agreed to the terms and conditions." I let her know that their terms and conditions did not supersede California law. I asked to speak to a supervisor. She hung up on me after informing me that there was nothing she could do. The representative I spoke to before Joan stated that the shipment had already been processed. Additionally, Section ******* continues, "In any case in which a business sends any goods, wares, merchandise, or products to a consumer, under a continuous service agreement or automatic renewal of a purchase, without first obtaining the consumer's affirmative consent as described in Section *******, the goods, wares, merchandise, or products shall for all purposes be deemed an unconditional gift to the consumer." In short, they billed illegally, and therefore a refund is due, and any shipment that may have been processed as a result of the illegal billing does not affect the necessity for a full refund.
This company preys on the uninformed consumer.
